Our Affiliates and Shared Marketing. We operate a family of affiliated brands and companies that share a common privacy program. Our affiliates include The Diamond Group, LLC; Scout Publishing Services, LLC; Bob Diamond, The Opportunity Examiner; The Wealth Creation Center, and Overages Blueprint; (each, individually and collectively, an “Affiliate” and, together, the “Affiliates”). When you provide information to, or opt in to communications on, any Affiliate’s website, you understand and agree that your information — including your contact information and your email and text-message (SMS) opt-in and consent status — may be shared among all of the Affiliates and used by each of them to market to you by email, text message, telephone, and mail, in each case consistent with the consent you provided and subject to your right to opt out as described below.

Collecting Your Information

We may collect information about you in a variety of ways, including when you provide information directly to us or when you visit our Website. We may also collect information about you from trusted third-party partners, such as the social networks and data providers. Categories of Information You May Provide to Us. This is information that you choose to provide directly to us, such as when you create an account, make a purchase, engage with our customer service team, fill out forms, opt in to our email or text-message lists, or otherwise use the Website. Sharing and Selling Your Information

We share, and we sell, the categories of information described above with and to third parties, including our Affiliates. The categories of third parties that we share or sell information with or to, including in the past 12 months, include: (1) our Affiliates; (2) service providers and suppliers; (3) marketing partners, advertising networks, and other purchasers of marketing and lead data; (4) data analytics providers; (5) data brokers and lead buyers; (6) payment processing providers; (7) social networks; and (8) other parties in connection with business transfers and for legal, safety, fraud prevention, and enforcement reasons.

Sale and Sharing of Lead and Customer Data. We sell and share consumer lead lists and customer lists — which may include identifiers and contact information such as name, postal address, email address, and telephone number, together with commercial/purchase information and user-activity data — to and with third parties, including marketing partners, advertising networks, data brokers, and other lead buyers, for monetary or other valuable consideration and for cross-context behavioral advertising. This activity constitutes a “sale” and/or “sharing” of personal information under the California Consumer Privacy Act and comparable state privacy laws. You have the right to opt out of this sale and sharing, as described in the “Do Not Sell or Share My Personal Information” and Your Privacy Rights sections below. We do not include on any list that we sell or share any telephone number, name, or other information for which we have received a do-not-call or do-not-contact request, and we do not sell or share unencrypted financial account numbers for use in telemarketing.

In the preceding 12 months, we have sold or shared the following categories of personal information to or with third parties for marketing, advertising, and lead-generation purposes: (1) identifiers, such as name, postal address, email address, telephone number, unique device identifiers, account information, and IP addresses; (2) commercial information, such as purchase history; and (3) user-activity data, such as information generated through your activities on the Website. The business and commercial purpose of this sale and sharing is to market and advertise our and third parties’ products and services and to generate and monetize marketing leads. We do not sell or share the personal information of consumers we know to be under 16 years of age without affirmative authorization as required by law.

We share your information with third parties for the following business purposes:

• Operate and Improve our Business. We share your information with third-party service providers that help us provide our services to you, increase the efficiency of our business, and improve our products and services.
• Process Transactions and Facilitate Customer Service. We may share information with third-party providers that process payments on our behalf, help provide the Website, and perform customer service functions. We may use third-party AI-powered virtual assistants to handle phone calls and customer support conversations on our behalf. These calls and chats may be monitored and recorded by the third party. We use chatbot tools that are provided by third parties who will monitor and record transcripts of your customer service chats to help us better manage our customer inquiries.
• Marketing, Advertising, and Lead Sales. We share and sell information with and to our Affiliates and third-party providers that support online advertising, data co-operatives, mobile advertising, data analytics, social media engagement, advertising networks, lead purchasing, or any other activity that may be considered cross-behavioral advertising, direct marketing, or a sale of personal information.
• Analytics. We may allow third-party service providers to use tracking technology on the Website, which will enable them to collect information about how you use the Website over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, and better understand your online activity.
• Security and Fraud Prevention. We share information with third parties that provide security and fraud protection services for us.
• Required By Law. We do not use the Website to solicit information from or market to children under the age of 18. By using the Website, you represent that you are at least 18 years of age. We do not knowingly sell or share the personal information of consumers under 16 years of age. We encourage parents and legal guardians to monitor their children’s internet usage and to instruct their children never to provide personal information through the Website or any other website without parental consent. If you believe a child has provided personal information to us via the Website, please contact us and we will use reasonable efforts to locate and delete the information.

SMS Messaging

Who may contact you. By opting in to our promotional text-message (SMS) program — for example, by checking the SMS consent box on a sign-up form and providing your mobile telephone number — you give your express written consent to be contacted by Us and each of our Affiliates, and their respective agents and vendors acting on their behalf, with marketing and promotional text messages at the mobile number you provide.

Nature of your consent. You agree that these messages may be delivered using an automatic telephone dialing system or automated, predictive, programmable, or similar dialing technology, and may include autodialed or prerecorded content. Your consent is not a condition of purchasing any property, goods, or services. Message frequency varies. Message and data rates may apply, and you are solely responsible for all charges billed by your mobile service provider.

How to stop messages. If you no longer wish to receive promotional messages by text, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. Reply HELP for help. Opting out of text messages from one Affiliate will opt you out of promotional text messages from all of the Affiliates, and we will honor your request promptly and in any event within the time required by applicable law.

Email. If you no longer wish to receive promotional communications by email, please follow the unsubscribe link located at the end of any email message. We will honor your opt-out within ten (10) business days, and opting out of one Affiliate’s promotional emails will opt you out of promotional emails from all of the Affiliates.

Sharing of messaging data. We may share your data, including your SMS and email opt-in and consent status, (1) among our Affiliates as described in this Privacy Policy, and (2) with third parties that help us and our Affiliates provide our messaging services, including platform providers, telephone carriers, and other vendors who assist in the delivery of text messages and emails. We do not authorize these messaging-service vendors to use your telephone number or opt-in status for their own marketing.

Telephone Marketing and Do Not Call

Marketing calls and texts. Where you have provided the applicable consent, We and each of our Affiliates (and their agents and vendors acting on their behalf) may contact you by telephone call and text message for marketing and promotional purposes, including through automated dialing technology and, where separately authorized, prerecorded or artificial-voice messages. Your consent to receive marketing calls or texts is not a condition of purchasing any property, goods, or services.

Your right to stop calls and be placed on our Do-Not-Call list. You may ask us to stop marketing calls at any time. When you make such a request, we will add you to our internal do-not-call list and will not make further marketing calls to you, and your request will apply to us and all of our Affiliates. We also maintain procedures to honor the National Do-Not-Call Registry and applicable state do-not-call lists.

How we identify ourselves. When we or our Affiliates make marketing calls, we will transmit a caller-identification name and telephone number and, on the call, identify the company on whose behalf the call is made and the purpose of the call, as required by law.

Calling times. We do not make marketing calls outside the hours permitted by federal and applicable state law. Some states set earlier evening cutoffs and other restrictions; we observe the most protective applicable limits based on your location.

State law. Some states — including Florida, Oklahoma, Washington, and our home state of Nevada — impose specific consent, timing, and identification requirements on marketing calls and texts, and provide their residents with additional remedies. We maintain procedures intended to comply with these requirements where they apply.

Do Not Sell or Share My Personal Information

Because we sell and share personal information (including lead and customer lists) as described in the Sharing and Selling Your Information section, you have the right to direct us not to sell or share your personal information. You may exercise this right at any time and free of charge, and we will not require you to create an account to do so.

You may opt out of the sale or sharing of your personal information in any of the following ways:

• Do Not Sell or Share Link. Use the “Do Not Sell or Share My Personal Information” link located in the footer of our Website homepages, and complete the online opt-out request form to which it directs you.
• Opt-Out Preference Signal (Global Privacy Control). We honor opt-out preference signals, such as the Global Privacy Control (GPC), that your browser or a browser extension sends to us. When we detect a recognized opt-out preference signal, we will treat it as a request to opt out of the sale and sharing of personal information associated with that browser or device. Because the signal is tied to a particular browser or device, it may not be associated with any account information unless you are logged in.

Nevada Residents. In addition to the rights above, Nevada residents may submit a verified request directing us not to make any “sale” (as defined under Nevada law) of certain covered information we have collected or will collect about them. To submit such a request, email us at support@diamondlawcenter.com. We will respond within 60 days of receipt, subject to a permitted extension of up to 30 additional days.

Do Not Track Signals

Do Not Track (“DNT”) is a privacy preference that users can set to have their internet browser automatically send a signal to our Website to request that we not track browsing activity across different sites. There is currently no universal standard for sending and receiving DNT signals. As such, we cannot promise that we respond to all DNT signals, but we do recognize and respond when required by applicable privacy laws. The verification steps may vary depending on the sensitivity of the information and whether you have an account with us. If we are unable to verify your identity, we may deny your requests to know or delete. You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and will verify your identity directly.
